1. Purpose

This Acceptable Use Policy ("AUP") outlines the rules for using Gleam's AI-powered communication services. By using our platform, you agree to comply with this policy and all applicable laws.

2. Compliance Requirements

You must comply with all applicable laws and regulations, including:

  • TCPA: Telephone Consumer Protection Act
  • TSR: Telemarketing Sales Rule
  • CAN-SPAM: Email marketing regulations
  • GDPR: General Data Protection Regulation (EU)
  • CCPA: California Consumer Privacy Act
  • State and local telecommunications regulations

3. Prohibited Activities

3.1 Illegal Activities

  • Any illegal purpose or to promote illegal activities
  • Fraud, scams, or deceptive practices
  • Identity theft or impersonation
  • Money laundering or financial crimes

3.2 Spam and Harassment

  • Unsolicited calls or messages without proper consent
  • Calling numbers on the Do Not Call registry without exemption
  • Harassment, threats, or abusive communications
  • Deceptive caller ID spoofing

3.3 Harmful Content

  • Content that promotes violence or harm
  • Hate speech or discriminatory content
  • Explicit adult content without age verification
  • Malware, phishing, or other malicious activities

4. Required Disclosures

When using AI agents, you must disclose:

  • AI Disclosure: That the caller/responder is an AI (where required by law)
  • Recording Disclosure: That calls may be recorded (in applicable states)
  • Business Identity: Your business name and purpose of the call
  • Opt-Out Instructions: How recipients can opt out of future communications

5. Consent Requirements

5.1 Express Consent

Required for:

  • Calls to mobile phones using AI/autodialer technology
  • Marketing calls to residential lines

5.2 Express Written Consent

Required for:

  • Marketing calls using AI/prerecorded messages
  • Must be clearly documented and include disclosure that AI may be used

6. Time Restrictions

You may not make calls outside of 8:00 AM - 9:00 PM in the recipient's local time zone, unless you have prior express consent. Our platform enforces these limits by default.

7. Do Not Call Compliance

  • Maintain an internal Do Not Call list
  • Honor opt-out requests within 30 days
  • Check the National Do Not Call Registry (for applicable campaign types)

8. Monitoring and Enforcement

We reserve the right to monitor usage for compliance with this policy. Violations may result in:

  • Warning and required remediation
  • Temporary suspension of services
  • Permanent account termination
  • Reporting to appropriate authorities

9. Reporting Violations

If you become aware of any violations of this policy, please report them immediately to: abuse@gleamai.dev

10. Updates to This Policy

We may update this policy at any time. Material changes will be communicated via email or in-app notification. Continued use of the Service constitutes acceptance of any changes.
